I hope someone can offer me some guidance?

My brother was Type 1 diabetic and died suddenly on 2nd April 2013 (aged 34)- this was the cause of death (his diabetes was within the stable boundaries). On this day i was on on holiday abroad and needlessly to say i flew straight back to the UK. The problem i have is that the insurance company are stating he had a pre-existing condition and took prescribed mediation so they will not refund me on flights and cutailment of my holiday. My brother was insulin dependant for years, led a fully functional life (in fact, he died on the way to work); he was not on holiday with me. Based on the insurance company arguement any family with diabetes in the family are not covered if the worst happens. Can anyone help me / point me in the right direction?

Heather, I am so sorry to hear of your loss. It might be worth contacting the Diabetes UK Careline service to discuss what has happened:

Also, perhaps the Citizen's Advice Bureau could help to find out where you stand legally. In my experience, insurance companies will almost always try to get out of making a payment and this is often something that works for them even if they are liable, so it is worth pursuing. Please let us know how things go, it seems awful that you should be having to deal with something like this at such a distressing time.

First and foremost, sorry for your loss, Heather73.

In addition to what Northerner has suggested:

Another organisation that might be able to help, once you have exhausted all lines of complaint with the company involved, is Financial Ombudsman - see http://www.financial-ombudsman.org.uk/faq/complain.html

Otherwise, most newspapers have consumer rights journalists and this sounds the type of case they could take up.

Very very sorry Heather. Hope you get to the bottom of this & really good luck. Duk has some very nice people who might be able to help.

Sorry for your loss heather.

I hope DUK or citizen's advice can help you.

So sorry for your loss Heather.

I cannot offer any words of advice re:insurance that haven't already been given but I would say that DUK have been helpful for me in the past.

Good luck, and big hugs

xx

No advice to offer beyond what's already been suggested, but I too want to express my condolences.
