Hi I've been a type 1 diabetic for 47 years and I've always come across problems with employers and the last one is no exception. I was made redundant after working for an employer for 6 1/2 years. I was finished in July this year. In 2010 I raised a grievance as I was reduced to doing my injection, at the time, in the ladies toilets. The outcome of the grievance was that if there was a medical emergency there was a room available but if I required to do my injection and the room was either occupied or booked I could not use it. I could only use the room if it was free.
I did not contest the outcome of the grievance as I knew there would be nothing further the company would do, I was naïve at the time with regards to the DDA.
I have involved the union to represent me about my redundancy payment and I have also brought up the way that I had been treated since 2010 and used the DDA and state that they did not make reasonable adjustments when requested. I was just wondering if anyone knew anything that is related to your Human Rights as the toilets were not hygienic enough to do injections even though I was forced to do them here.

ACAS the Advisory, Conciliation and Arbitration Service can be very useful in cases like this Joanna.
Also your Union will be able to obtain legal advice for you with the lawyers they contract with.

I notice from the DUK link that they cannot give legal advice but may be able to give general supportive info.

This link is very useful in explaining employees rights under the DDA and the whole area of discrimination.

Employers are required (but not mandated) to follow the ACAS code of conduct in their employment dealings and it goes against them in an Employment Tribunal if they haven't. They can give advice on the number below;


'For employment advice call our helpline on 0300 123 1100.

These services are normally chargeable unless our statutory duty to apprehend or resolve a dispute is triggered.'

Good luck. This kind of discriminatory treatment is appalling!
