Documents reveal one in 10 inspectors working for Care Quality Commission failed competency tests but will not be fired.

The regulator in charge of NHS hospitals has hired 134 inspectors who failed basic competency tests - and claims it cannot get rid of them for fear of being sued, official reports reveal.

The Care Quality Commission (CQC) recruited the staff in 2012 when it was under fire for failing to protect the public, following a series of scandals in the NHS and care sector.

Internal documents reveal that the watchdog appointed dozens of inspectors who failed “some or all of its recruitment activities” during a “significantly flawed” hiring process.

It means one in 10 inspectors now employed to visit hospitals and care homes should never have been given the job.

The report, presented to CQC’s audit committee, says the regulator’s judgements about the safety of the institutions it visits “may be impaired” because of the failings.
