An NHS whistle-blower is threatening to disclose damaging correspondence which he claims will prove that his ?500,000 gagging order was officially sanctioned by the Department of Health.

Gary Walker, the former chief executive of United Lincolnshire Hospitals Trust, claims that he warned Sir David Nicholson four years ago that patients were at risk at his trust.

Mr Walker was paid more than ?500,000 by the trust as part of a severance deal which prevented him from speaking out over his concerns about patient safety. Giving evidence to MPs on Tuesday Sir David, the chief executive of the NHS, said gagging orders were ?unacceptable?, but insisted that Mr Walker?s deal was not signed off by the Department of Health.

Mr Walker said he would ?provide evidence? that his payment was sanctioned by the department ?in due course?.

He told The Telegraph it was ?inconceivable? that Sir David and other officials from the department were not aware of the order. ?[David Nicholson] is simply trying to mislead everyone about his knowledge,? Mr Walker said. ?I will provide evidence that shows this to the select committee in due course.?

The official reason for Mr Walker?s sacking in 2010 was that he swore openly at meetings.
