A six-year-old boy who suffered a catastrophic brain injury after contracting herpes has won a record £37 million NHS compensation payout.

Following his birth at Watford General Hospital, the youngster was infected with the virus, which developed into a devastating brain fever, a court heard.

The infection 'should have been but was not detected and acted upon' soon enough, according to his barrister Henry Witcomb QC.

Treatment was delayed by two days, resulting in 'catastrophic damage to his brain', he told London's High Court.

A ridiculous amount of money. Who is that for? That doesn’t represent the amount of money needed to care for the lad, even if he lived to age 90. How do they work these thing out?

If they think that’s what it costs for 24 hour care, maybe they should have a look at Carers Allowance.

I think you has mis read it.
That's the estimated capitalised total payment over his lifetime.
Not paid today, and not todays money.

Who knows what the carers allowance will be in 2100.
it may be tens of thousands more, it may not exist.

I didn’t misread it.

For info, carers allowance is £64.60 a week. (In Scotland it will soon be £8 or so higher). And it’s capped - if your income is more than £120 a week, you can’t get it. So that’s what the government thinks is appropriate for 24 hour care. It’s obviously more expensive for professional care, so most people have to do without, or get minimal service - these days, anyway.

I doubt he'll need to worry about the income cap.

And I suspect he may quality for enhanced PIP and mobility rates too.

True. That comes to about £5000 a year. I agree he won’t worry about the income cap, I mentioned it because everyone else has to.
