The Montana Supreme Court said Friday obesity without a physiological cause may constitute ?physical or mental impairment? under the Montana Human Rights Act, potentially giving obese people greater protection against firing or other kinds of discrimination.
In a 4-3 decision, the high court responded to a question from a federal judge and said obesity may count as an impairment if the individual?s weight is outside ?normal range? and affects ?one or more body systems? as defined under the Americans With Disabilities Act.
