Hi all,

My partner has just been diagnosed as T1. He is now on insulin injections. His current employment is as a HGV driver. His company have basically turned around and said he either goes on SSP for 3 months until the DVLA assess him, or he can be off unpaid. Surely this isn’t right? Surely there has to be some level of reasonable adjustments made. His HR department have basically said ‘tough, you’re employed as a HGV driver, and you can’t drive’

Any advice?

What was his contract with regard to sick pay?

He needs to check what his contract says about sick pay

Hi , how long has you husband worked for the company ?
 
Statutory sick pay, no sick policy as such. He has worked at the company nearly 3.5 years.
 
Hi ,

from personal experience your husband's employer attitude seems rather unkind to say the very least.From the sound of the HR department comments suggest that they are a small haulage contractor.

I would suggest that you keep an accurate record all phone calls etc re dates / times and who you spoke to.

Have they offered your husband as a temporary measure other paid employment to cover the licence suspension period ?

If I could make a suggestion I would make an appointment to see Citizens advice and see what advice they can offer.

Your husband HGV suspension licence is automatic but could I suggest that he thinks about future employment prospects if his licence is not renewed after the three months suspension.

I am not legally qualified but I understand that in law just husband is now regarded as disabled that brings greater legal protection for him.

Could I suggest that you don't answer these questions in a general forum but if other members can suggest other options that would be great.
 
Hi Tilly, sorry I’m late replying to this, as I haven’t looked on the forum for a while. I have just recently got my Hgv licence back from dvla after being diagnosed as a type 1 back in Sept 2021. Unfortunately it takes a lot longer than 3 months. Basically you have to see 3 separate drs, who assess you and check that you have tested on your blood testing monitor at least twice a day, EVERY DAY, regardless as to whether you drive or not, for 3 months. I mistakenly missed a couple whilst on holiday, and that set me back approximately 3 months. It’s a long process, and although my company were very good, the fact is you are not able to do the job you are supposed to be doing. In the end I left and took on some van driving work ( only up to 3.5 t though as that’s the max). Please be prepared for the whole scenario to take around 12 months. Sorry
