Has anyone fell foul of the DVLA tardiness in renewing their licence.
As a self-employed garden service, it's critical to my business.
I was under the impression that your GP can fill out a Fitness To Drive form (DOM3854) to allow a person to drive whilst waiting for the bureaucratic wheels to turn in their turgid mud.
On requesting my GP to fill the above form in, her reply was no, as the BMC have said they shouldn't because they would be open to litagation if there was a accident.
What tosh, a GP is the only avenue open for a Diabetic to be oked to drive. The DVLA only uses a GP for a Fitness To Drive and no other evidence.
Has anybody else found their GP not to be sympathetic to their urgent need for a licence.
I will for one will not let this issue to lie. Every Avenue even the local press, CAB will be contacted to get this intransigence overturned.
 
If this is a renewal of your licence you are entitled to carry on driving as long as you haven't been told to stop by a medical professional. This info is included in the renewal forms that were sent to you.
 
Sorry you are having problems with the delays currently experienced at the DVLA.

As Sue says, as long as your GP has confirmed that you are still fit to drive, you can continue to drive under Section 88.

The following information was received by Diabetes UK from the DVLA recently (my emphasis)…

The DVLA have confirmed, via email, that:

where the driver has submitted a licence renewal application but a new licence has not been issued by the renewal date, the driver can in certain circumstances continue to drive by virtue of the provisions of Section 88 of the Road Traffic Act – https://www.gov.uk/government/publications/inf1886-can-i-drive-while-my-application-is-with-dvla

To do this the driver must satisfy themselves that they meet the following criteria:
· A doctor or optician has not advised you not to drive
· If you have an existing medical condition your doctor must have told you that you are fit to drive. If your doctor is unsure about how a medical condition affects driving, they should refer to ‘Assessing fitness to drive – a guide for medical professionals’ at www.gov.uk/dvla/fitnesstodrive
· You have held a valid driving licence and only drive vehicles you have applied for on your current application and were entitled to drive on your previous licence.
· If you hold a Group 2 (bus or lorry) licence, your entitlement has not been suspended, revoked or refused by a traffic commissioner.
· You meet any conditions that were specified on your previous licence that still apply.
· DVLA has received your correct and complete application within the last 12 months.
· Your last licence was not revoked or refused for medical reasons.
· You are not currently disqualified from driving by a court.
· You were not disqualified as a high risk offender on or after 1 June 2013 (a high risk offender is a driver convicted of a serious drink driving offence).

The DVLA do not only rely on a GP.
99.9% of drivers do not have their GP contacted about their fitness to drive.

When I was diagnosed with MS I had to inform the DVLA , as it was a new condition they wrote to the consultant in neurology for info, I was allowed to continue driving with no problem as it took 12 weeks for the consultant and DVLA to finish their letter writing. My GP or diabetes team have never been contacted regarding my diabetes or fitness to drive and I've held a full licence for 37 years. Bike licence for 43 years

Doctor presumably said she was fit to drive 3 years ago, and that surely must still be the case unless the doctor has said they're not unfit. Theres no time limit given in Section 88 or in the DVLA advice (would I trust my opinion in court, probably not)

I’ve never asked the GP to fill in this form, you can continue driving whilst waiting for a standard licence to be renewed without anything in writing from your GP or any other HCP. The only exception is if you know you’re not fit to drive or you’ve been advised not to drive.
 
Is that standard renewal form, if so shouldn't need dr to fill in form, sure dvla write directly to drs consultants for evidence for your fitness to drive if need be after you send back renewal form.
 
My GP didn't fill in any form but he did put a note on my records to say i had spoken to him and that he agreed to my fitness to drive under Section 88 after asking a few questions
My licence took so long to come back, i resorted on contacting my MP. It is a government department after all. Good luck.
