Hi guys and gals.

I know a mother and son where the mum 67 claims disability and uses it for a car. However her son doesn't have a car so she gave it to him and he upgraded it all in her name for a brand new BMW 1 series cabriolet. He works in a college and uses this car for work and social purposes. She never uses this car! Is this allowed? I've never claimed for anything and they ripped off my sister of 5k when he was going out with her.my sister wants to shop them?can she do this? And is this right? The mum sold her £360k house and downsized for one for £150k does she have to declare this income? Is there a benefit line that u can use? Please give me advice?
 
Yes that is fraud and there is a benefits fraud helpline you can call. Her son can not use the car unless it's to take her out or he is running errands for her. So the way he is using it is wrong. Also she has to declare if she has more than 6000 in savings, it may have gone up to 10000, but still you get the idea.

Dear Mrs Mad thank you. It leaves a bad taste in my mouth that these people are ripping off the system and people who really need this help dont get the full benefits. Thank you for the advice. Maybe i should become Miss Marple and take photos every day of this fraud!!!
 
As I understand it, cars bought/leased under the motorbility scheme can be driven by any person nominated by the benefit recipient. I don't think what they are doing is illegal even though it's highly immoral and should be illegal.


However large cash sums should be declared if this person receives support benefits.



ETA The car is leased by a person using their benefits, they could if they wish use those same benefits to buy a car outright if they wish so who uses it is quite irrelevant. Whether those people are entitled to that benefit is what the last government and indeed the coalition have received so much criticism in trying to decide fairly and lead to Labour giving a contract to ATOS who we all know about.

I get very annoyed when I hear about this kind of rip off.

You can report it, and you can (I think) do it anonymously. Find out about it anyway as the fraudsters make life even more difficult for those who really need it.
 
If the terms and conditions are still the same it isn't illegal or fraud under the motability scheme, the vehicle is provided to assist with transport for someone with a disability but the person with the disability doesn't have to be the primary driver or a driver at all. Mostly because it wouldn't be practical to insist the claimant be the driver because some people entitled to the car wouldn't be able to drive. It's pretty hard to prove that the car is being misused but you could give it a try. It would be against the terms of the blue badge scheme if he was using the badge to park without the claimant in the car.
 
Hi YPauly thanks for the advice. It doesn't seem right that he is driving a car as his own and his mother has her own car. He told my sister when they were going out that his mum instead of claiming disability as moneys she would get a car for him and he would give her monthly £ so he never takes her to doctors or check ups, she drives her own car there and takes her grand kids to school. She claims for arthritis as faras i know. It seems so unfair that the system can be abused this way.
 
Thanks kookycat. The thing is she doesn't nominate him to take her anywhere she has her own car. And the BMW she got through motorbility he has it for all his own use. That can't be right can it? He gets free tax for the car because its a motorbility car for him who is mobile. It makes me cross

That doesn't sound right at all - if she already has a suitable car then that should be the designated car. If she can use that car, then I would say it sounds fraudulent because she doesn't need him to drive! 😡

Ah now that's something you can use, if the car is registered in her name (her car not the motability car) then that could swing it. They probably get insurance as well. Motability is now linked to whatever they're now calling disability allowance, so income and capital should be declared. It is really disgraceful when there are so many genuine people struggling to get any kind of support 😡
 
Hi Northerner,that's what I thought. She drives her own car everywhere. He and my sister went in that car everywhere holidays, work and she asked him how he could afford it because he never had any £ when he was drunk he told her and he said only he and his mum knew about it. He's a teacher and drives to all the campuses in that car, its sickening. Surely this can't be right, would hs employer be happy for a teacher whom is in a position of trust can be doing this. By the way he is claiming mileage from the school to be back and forth different campuses at 45p per mile!!!
 
Ah I see kookycat. I am going to look into it as its not right. He dumped my sister by text in April. She has suffered with depression since it as she was left so abruptly with no idea of this snake!!! He had got a young woman pregnant!!! My sis loved him and he took advantage even lending £ off her which he never paid back. I want karma.

What a peach he is, I wanted to use another P word but don't want to offend anyone. It'd be worth the investigation even if they can't pursue it, because maybe they will think more carefully about their actions.

DLA (or whatever it's called now) is not means tested so it doesn't matter if you have £2 or £200,000 so if this is the only thing being claimed then income is not n issue. If they are also claiming income support or housing benefit then savings etc must be taken into account. With the motability cars then other people can use them as long as it's for the benefit of the person with the claim, a bit of a grey area and will be difficult to prove. If the car is for the sole use of her son then the money for that is coming out of her entitlement as you either get money or a car for mobility component

Misuse of the Motability Scheme is something we take very seriously. We rely on the general public, customers, police, Department for Work and Pensions, and others to help us put a stop to it. Every report of misuse we receive is carefully assessed and, if proven, acted upon.

Due to data protection laws, we can not share any action we may take against an individual with you, but that doesn't mean we are not taking action. Misuse can be reported using the misuse of the scheme form or, by calling our Customer Services team.
 
It is a grey area, I keep receiving letters telling me I qualify for a motability car and it would give me back my independence which makes me smile as I am partially sighted and have had my driving licence revoked. You can nominate drivers as long as they agree to the terms of the lease and live within 5 miles of your address if I remember correctly. If I chose to join the scheme I would never be the driver. The cars you can choose are limited to certain types and only certain garages deal with motability cars.

I haven't taken them up on the offer and use the train and bus instead.
 
Hi Aoife thank you for your message. I know they are not paying full council tax he said this to my sister so he's a real shirker in my eyes. The car has never been used to ferry his mum around of help her. She has her own car apoarently my sis said his mum was entitled to mobility and instead of the £ she took the car and its used as his. He goes everywhere in it!! It's distasteful
 
Hi John that is most interesting. Im gathering facts and i am going to report it. My sister will have to show proof he spent 3 years with her and they went everywhere in the car, holidays etc she even drove it to drop him to work then get to her employer and picked him back up from work to save diesel. I was like miss Marple today i took a photo of his car outside his workplace. Going to be on it. He ripped my sis off for 5k its his turn to have the tables turned on him.
